Welcome to BioReport.
These Terms & Conditions ("Terms") govern your access to and use of the BioReport website, applications, and services available through BioReport.app (the "Service").
By creating an account, accessing, or using the Service, you agree to be legally bound by these Terms. If you do not agree, please do not use BioReport.
1. Eligibility
You must be at least 18 years old to use the Service.
By using BioReport, you represent and warrant that:
- You are at least 18 years of age;
- You have legal capacity to enter into these Terms;
- You are legally permitted to upload the information and documents you provide.
2. Medical Disclaimer
BioReport is NOT a medical device.
BioReport is not intended to diagnose, treat, cure, prevent, or monitor diseases.
BioReport does not provide:
- Medical advice;
- Medical diagnosis;
- Treatment recommendations;
- Emergency medical services;
- Clinical decision support.
The charts, trends, biomarker ranges, notifications, and other information displayed by the Service are provided for informational and educational purposes only.
You should always seek advice from a qualified healthcare professional before making any medical decisions.
You agree that you use the Service entirely at your own risk.
3. User Accounts
You are responsible for:
- Maintaining the confidentiality of your credentials;
- Restricting access to your account;
- All activities performed under your account.
You must immediately notify us of any unauthorized use of your account.
We are not responsible for losses caused by unauthorized access resulting from your failure to secure your credentials.
4. Uploaded Content and Health Data
You retain ownership of:
- Uploaded laboratory reports;
- Biomarker data;
- Health-related documents;
- Other personal information uploaded to the Service.
By uploading content, you grant BioReport a non-exclusive, limited license to:
- Store your content;
- Process uploaded documents;
- Extract laboratory values;
- Normalize biomarkers;
- Display charts and timelines;
- Provide Service functionality.
This license exists solely for operating and improving the Service.
This license does not permit us to use your data, including anonymized, aggregated, or de-identified data derived from it, to train, fine-tune, or evaluate AI models - our own or anyone else's.

5. User Responsibilities
You agree that you will NOT:
- Upload illegal content;
- Upload malicious software or viruses;
- Attempt unauthorized access to our infrastructure;
- Reverse engineer the Service;
- Interfere with servers or security systems;
- Use automated bots that overload the Service;
- Upload information belonging to others without authorization.
You are solely responsible for the legality and accuracy of all uploaded information.
6. Subscription and Payments
If BioReport offers paid subscriptions:
Billing
Subscriptions are billed on a recurring basis:
- Monthly;
- Annually;
depending on the selected plan.
Auto-Renewal
Subscriptions automatically renew unless canceled before the next billing cycle.
Cancellation
You may cancel your subscription at any time through your account settings.
Cancellation prevents future charges but does not refund previously paid amounts.
Refund Policy
Except where required by law:
All payments are final and non-refundable.
7. Service Availability
BioReport strives to provide reliable service but does not guarantee:
- Continuous availability;
- Error-free operation;
- Uninterrupted access;
- Permanent storage of uploaded data.
The Service may be:
- Temporarily unavailable;
- Modified;
- Suspended;
- Discontinued;
at any time and without prior notice.
8. Data Backup
Although we employ backup procedures and security measures, you remain responsible for maintaining your own copies of important medical records and documents .
BioReport shall not be liable for:
- Loss of uploaded files;
- Corrupted documents;
- Accidental deletion;
- Failure of backup systems.
9. Intellectual Property
The Service and all related intellectual property rights belong exclusively to BioReport.
This includes:
- Software;
- Source code;
- Design;
- User interface;
- Graphics;
- Logos;
- Algorithms;
- Data processing methods;
- Biomarker normalization systems;
- Databases.
Nothing in these Terms transfers ownership of BioReport intellectual property to users.

12. Disclaimer of Warranties
THE SERVICE IS PROVIDED:

WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOREPORT DISCLAIMS ALL WARRANTIES, INCLUDING:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- NON-INFRINGEMENT;
- ACCURACY OF RESULTS;
- AVAILABILITY OF THE SERVICE;
- MEDICAL ACCURACY OF INFORMATION.
WE DO NOT GUARANTEE THAT:
- RESULTS WILL ALWAYS BE CORRECT;
- OCR EXTRACTION WILL BE ERROR-FREE;
- ALL LAB REPORTS WILL BE PROCESSED SUCCESSFULLY;
- THE SERVICE WILL ALWAYS BE AVAILABLE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
BIORREPORT SHALL NOT BE LIABLE FOR:
- Medical decisions made based on information from the Service;
- Personal injury;
- Loss of health opportunities;
- Lost profits;
- Lost data;
- Business interruption;
- Indirect damages;
- Incidental damages;
- Consequential damages.
THIS APPLIES EVEN IF BIORREPORT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED:
THE AMOUNT YOU PAID TO BIORREPORT DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
If you use the free version of the Service:
BioReport's total liability shall be limited to USD $100.
14. Indemnification
You agree to defend, indemnify, and hold harmless BioReport, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:
- Your use of the Service;
- Uploaded content;
- Violation of these Terms;
- Violation of any applicable law;
- Infringement of third-party rights.
15. Force Majeure
BioReport shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including:
- Natural disasters;
- War;
- Cyberattacks;
- Government actions;
- Internet outages;
- Power failures;
- Third-party service interruptions.
16. Account Suspension and Termination
We reserve the right to:
- Suspend your account;
- Restrict access;
- Delete content;
- Terminate the Service for a specific user;
at our sole discretion and without prior notice if:
- These Terms are violated;
- Illegal activities are suspected;
- Security risks are detected;
- The Service is abused.
17. Changes to the Service
We may:
- Add features;
- Remove features;
- Modify pricing;
- Change subscription plans;
- Change technical requirements;
- Discontinue parts of the Service;
at any time and without liability.
18. Changes to These Terms
We may update these Terms periodically.
Updated Terms become effective when published on BioReport.app.
Continued use of the Service constitutes acceptance of the updated Terms.
